1. Acceptance of Terms
By accessing or using TrulyInbox ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Ikigai Infotech LLP ("Company", "we", "us", or "our").
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of that organization.
2. Description of Service
TrulyInbox is an AI-powered email warmup and deliverability improvement service. The Service provides:
- Automated email warmup to gradually build sender reputation
- Human-like email interactions (sending, receiving, opening, replying) to bypass spam filters
- Email deliverability monitoring and analytics
- Sender reputation tracking and insights
- Multi-account management dashboard
- Integration with major email providers via OAuth and SMTP/IMAP protocols
The Service is designed for legitimate business communication and outreach purposes. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
3. Account Registration and Security
To use the Service, you must create an account and provide accurate, complete, and current information. You agree to:
- Provide truthful and accurate information during registration
- Maintain and promptly update your account information
- Keep your account credentials confidential and secure
- Notify us immediately of any unauthorized access or security breaches
- Accept full responsibility for all activities that occur under your account
- Not share your account with others or allow multiple users to access a single account
You must be at least 18 years old to use the Service. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Subscription Plans and Payment
TrulyInbox offers both free and paid subscription plans with varying features and limits. By subscribing to a paid plan, you agree to the following:
- Billing Cycles: Subscriptions are billed on a monthly or annual basis, as selected during signup
- Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled
- Payment Method: You must provide a valid payment method and authorize us to charge applicable fees
- Price Changes: We may modify subscription prices with at least 30 days' notice
- Refunds: All fees are non-refundable except as required by law or explicitly stated in our refund policy
- Cancellation: You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- Failed Payments: If payment fails, we may suspend or terminate your access to paid features
Free plan users may be subject to usage limits and feature restrictions. We reserve the right to modify plan features and limits at any time.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You expressly agree NOT to:
- Send unsolicited bulk emails (spam) or engage in any form of email abuse
- Use the Service to send phishing emails, malware, or malicious content
- Violate CAN-SPAM Act, GDPR, or any other email marketing and privacy regulations
- Impersonate any person or entity or falsely represent your affiliation
- Use the Service to harass, threaten, defame, or abuse others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use automated means to access the Service except through our provided API
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, redistribute, or sublicense the Service without our written permission
TrulyInbox is designed for legitimate business outreach and email deliverability improvement. We actively monitor for abuse and reserve the right to immediately suspend or terminate accounts that violate these policies.
6. Email Account Access
To provide the Service, you grant us limited access to your email accounts through OAuth authorization or SMTP/IMAP credentials. By connecting your email account, you acknowledge and agree that:
- We will access your email account solely to perform warmup activities and deliverability monitoring
- We will send and receive emails on your behalf as part of the warmup process
- We will not read, access, or use your personal emails outside of warmup-related activities
- You can revoke access at any time through your account settings or email provider's security settings
- You are responsible for ensuring your email provider's terms allow the use of automation services
- We implement industry-standard security measures to protect your credentials and email data
We store OAuth tokens and SMTP/IMAP credentials securely using encryption. You remain the owner of your email accounts and all content within them. Revoking access will disable the Service for that email account.
7. Intellectual Property
The Service, including all software, designs, text, graphics, logos, and other content, is owned by Ikigai Infotech LLP and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
You retain all rights to your data, including email content, contact information, and analytics data. By using the Service, you grant us a limited license to process and store your data solely for the purpose of providing the Service.
You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software without our express written permission. The TrulyInbox name and logo are trademarks of Ikigai Infotech LLP and may not be used without authorization.
8. Data and Privacy
We are committed to protecting your privacy and handling your data responsibly. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability and SLA
We strive to provide reliable and consistent service availability. However, you acknowledge and agree that:

- We do not guarantee 100% uptime or uninterrupted access to the Service
- Scheduled maintenance, updates, and upgrades may temporarily disrupt service
- Third-party services (email providers, hosting, etc.) may cause interruptions beyond our control
- We make reasonable efforts to maintain high availability and minimize downtime
- Service Level Agreement (SLA) terms for paid plans are specified in your subscription agreement
We will provide advance notice of planned maintenance when possible. In the event of unplanned outages, we will work to restore service as quickly as possible.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Ikigai Infotech LLP, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Business interruption or downtime
- Damage to sender reputation or email deliverability
- Email account suspension or termination by third-party providers
- Any other indirect or consequential damages
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Ikigai Infotech LLP, its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms or any applicable laws or regulations
- Your violation of any rights of another person or entity
- Content you submit or transmit through the Service
- Your email campaigns or outreach activities conducted using the Service
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.
12. Termination
Termination by You: You may terminate your account at any time by accessing your account settings or contacting our support team. Termination does not entitle you to a refund of any fees already paid.
Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent or illegal activity
- Non-payment of fees
- Extended period of inactivity
- Abuse or misuse of the Service
- At our sole discretion for operational or business reasons
Effect of Termination: Upon termination, your right to access and use the Service will immediately cease. We will delete or anonymize your data within 90 days of termination, except where required to retain data for legal or regulatory compliance. You may request an export of your data before termination by contacting support.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and notify you through one or more of the following methods:
- Email notification to your registered email address
- In-app notification when you log in to your account
- Notice on our website or blog
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.
Material changes that significantly affect your rights will be communicated with at least 30 days' advance notice.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts of Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the Service.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms constitute the entire agreement between you and Ikigai Infotech LLP regarding the Service and supersede all prior agreements and understandings, whether written or oral.
